1. Introduction
maxclicks lab, LLC (“maxclicks,” “we,” “us,” or “our”) provides maxinja, the AI assistant and AI features of the maxclicks Service, including content personalization (Adaptyle) and AI-generated audiences, segments, and automation logic (together, the “AI Features”). These maxinja AI Assistant Terms supplement, and are part of, our Terms of Service and Privacy Policy. By using the AI Features, you agree to these terms. Capitalized terms have the meaning given in the Terms of Service.
2. How maxinja works
When you use the AI Features, you describe what you want in plain language. maxinja sends your prompts, any files you attach, and the specific space data you reference (your “Inputs”) to AI model providers through an AI gateway, and returns generated results (your “Outputs”), such as email content, a readable description of an audience or condition, and the logic behind it. The underlying generated expressions run on our servers and are not exposed in the dashboard or returned through the API. The current AI model providers are listed in our Privacy Policy, and may change as the Service evolves.
3. Inputs and Outputs
As between you and us, you retain whatever rights you have in your Inputs, and, to the extent permitted by law, we assign to you our rights in the Outputs generated for you. You are responsible for your Inputs and for your use of Outputs, including ensuring you have the rights to the data you provide and that your use of the Outputs is lawful. Because AI generates results probabilistically, Outputs may not be unique, and similar Outputs may be generated for other users.
4. No training on your data
We do not use your Customer Data, Inputs, or Outputs to train our own AI models. We send AI requests to providers through their commercial APIs, which under their terms do not use API inputs or outputs to train their models. We use AI only to provide the Service to you and as described in our Privacy Policy.
5. AI limitations and your responsibility to review
AI Features are powerful but imperfect. Outputs may be inaccurate, incomplete, outdated, biased, or unsuitable for your purpose, and they do not constitute legal, financial, medical, or other professional advice. You are responsible for reviewing and approving any Output before you rely on it or act on it, especially before sending email, defining an audience, or publishing an automation. maxclicks provides human-readable descriptions for confirming what was generated; review them. You are solely responsible for the messages you send and the decisions you make using the AI Features.
6. Acceptable use of maxinja
The AI Features may be used only in a responsible and legal manner. You may not use maxclicks products, nor any third-party products or applications that interoperate with our services, to generate or distribute harmful content, including the following:
- Child sexual abuse material (CSAM). This encompasses, but is not limited to, the creation, distribution, possession, or promotion of any content, materials, or information that involves the sexual exploitation or abuse of minors.
- Content that promotes or encourages violence, hate speech, discrimination, or other illegal activities.
- Content that targets or exploits individuals or groups of people, including children.
- Content that threatens or harasses individuals or groups of people.
- Misleading or deceptive material, including content intended to deceive or mislead people or to influence political campaigns and processes.
- Adult content, including pornographic, NSFW, overly intimate content, or sexual abuse and exploitation content.
- High-risk uses that could result in death, injury, or serious bodily harm.
- Providing legal, financial, professional, or other individualized advice that would normally be provided by a licensed professional.
You also may not attempt to extract, reverse engineer, or reconstruct the underlying models, prompts, or generated expressions; use prompt injection or other techniques to bypass safety measures or access data that is not yours; use the AI Features to develop a competing AI model or service; or place an unreasonable load on the AI Features beyond documented fair-use limits. Customers who violate this policy may have their access to the AI Features or their accounts suspended or terminated.
7. Credits and billing
The AI Features consume Credits. Building something is usually a small one-time cost, while per-recipient work (most notably personalizing email, where each recipient is a separate AI pass) is where cost adds up. Every action is itemized in dollars in your billing usage log after it runs. Pricing and Credit details are on our pricing page and are governed by the Terms of Service.
8. Third-party AI provider terms
Your use of the AI Features is also subject to the acceptable use policies of the AI model providers we use. We may add, remove, or change providers and models, and may adjust limits, to maintain quality, safety, and reliability.
